Section 53: Section 268 of the Companies Act, 2009, is amended in

“(1) The court may appoint one or more competent inspectors to investigate the affairs of a company and to report thereon in such manner as shall be directed (a) in the case of a company having a share capital on the application of members holding 10% or less of the shares issued; 18 19 238 of Act 2009. 240 of Act No 5 of 2009. 241 of Act 2009. 247 of Act 2009. 248 of Act 20 09 268 of Act 2009. (b) in the case of a company not having a share capital, on the application of 10% or less of the persons on the company’s register of members; and (c) in any other case, on the application of the company”.
