Section 71: If a contracting authority–

(a) enters into a PPP Agreement with a private partner without having received all required approvals from the Council and the Unit, as set out in Parts III and IV; or (b) enters into a PPP Agreement with a private partner in contravention of a direction given by the Council under section 44, the PPP Agreement shall be a nullity and unenforceable as against either the contracting authority or the private partner.
