Section 26, Weights and Measures Act, 2010

(1) Where an offence under this Act or under any statutoryinstrument made thereunder is committed by a body of persons– (a) where the body of persons is a body corporate, every director or officer of that body corporate shall be deemed to have committed that offence; and (b) where the body of persons is a firm, every partner of that firm shall be deemed to have committed that offence. Offences by Inspectors. Offences by bodies of persons. Obstruction, etc. of Inspectors. (2) No person shall be deemed to have committed an offence under subsection (1), if he proves that the act in respect of which he is charged was committed by some other person without his consent or connivance and that he exercised all such diligence to prevent the commission of that act as he ought to have exercised having regard to all the circumstances.
