Section 21, The Finance Act, 2022

Section 1 of the Public Procurement Act 2016 is amendedby repealing and replacing subsection (3) with the following new subsection– "(3) Where the minister responsible for defence or national security, with the approval of the Defence Council, determines that a procurement related 12 13 of section 40 of Act No. 9 of 2011. of section 1 of Act No. 1 to national defence or national security requires the application of special measures, the rules and procedures set out in this Act shall not apply but special measures shall apply which shall be governed by defence or national security considerations".
