Section 36, The National Communications Authority Act, 2022

(1) Subject to this Act no entity or person shall - (a) provide electronic communications services; (b) operate an electronic communications network; (c) operate a radio frequency unless the entity or person holds a licence issued by the Authority under this Act. (2) Any entity or person who contravenes subsection (1) commits an offence and is liable to a fine equivalent to the licence fees applicable to the type of service provided or a term of imprisonment not less than two (2) years, or to both a fine and imprisonment.
