Section 54, The National Communications Authority Act, 2022

(1) The Authority may limit the number of individuallicence for any category of electronic communications services , the establishment and operation of electronic communications infrastructure, only to the extent required to guarantee the efficient use of the scarce resources and minimise duplication of infrastructure. (2) Where the Authority intends to limit the number of individual licences granted it shall (a) give due consideration to the need to maximise advantages for users and facilitate the development of competition; (b) give interested parties the opportunity to express their opinion on any planned limitation; (c) establish its decision to limit the number of individual licences, as well as the justification for that decision, in the Gazette and on its website
