Section 43, The Local Government Act, 2004

(1) Each local council shall, in the discharge of itsfunctions, establish the departments specified in the Fourth Schedule,
and may establish thematic functional departments after consulting
the Commission.
(2) Each local council shall be responsible for the
preparation, administration and control of budgetary allocations of
the departments.
