Section 41, The Public Procurement Act, 2004

(1) Subject to approval by the procurement committee,restricted bidding may be held in the following cases:–
(a) when the goods, works or services are only
available from a limited number of bidders;
(b) when the time and cost of considering a large
number of bids is disproportionate to the
estimated value of the procurement.
