(1) Part V of the Income Tax Act,2000 shall not apply tomineral operations conducted under a large –scale mining licence. (2) Where a person conducting mineral operation qualifies for treatment under subsection (2) of section 4 and Part V of the First Schedule of the Income Tax Act, 2000, the provisions shall apply for the purposes of determining the person’s income tax liability with respect to the mineral operations notwithstanding section 4 of this Act.
