Section 46: A person who –

(a) contravenes or fails to comply with a road worthiness requirement for brakes or steering-gear; (b) uses on a road a motor vehicle or trailer which does not comply with such a requirement, or causes or permits a motor vehicle to be so used; or (c) uses or permits to be used on a road, a motor vehicle or a trailer, the tyres of which are not of the required specification for the vehicle or trailer or that are worn out,
