Section 22, The Public Private Partnership Act, 2014

A PPP Agreement shall stipulate how compensation dueto either party shall be calculated in the event of termination of the PPP Agreement and shall provide, where appropriate, for compensation for the fair value of works performed under the PPP Agreement, costs incurred or losses sustained by either party, including, as appropriate; lost profits subject to independent assessment pursuant to section 61 of this Act.
