Section 105, The Mines and Minerals Act, 2009

Notwithstanding the provisions of section 26, a personshall not be eligible to apply for the grant of a large-scale mining licence under this Act unless that person is a company incorporated or registered under the Companies Act and whose name has not been struck off the register of companies at the time of the application.
