Section 46, The National Communications Authority Act, 2022

(1) An entity or person who wishes to resell on a smallscale, electronic communications service , the commercial operation of the value-added services and provide internet services shall not be required to submit a declaration of the offer to the Authority. (2) An entity or person who wishes to resell on a large scale electronic communications service, the commercial operation of the value added services and provide internet services shall submit a declaration of the offer to the Authority. (3) For the purpose of this section declaration means the act of registering an electronic communication activity with the Authority by an electronic communications network operator or electronic communication service provider who is not required to obtain a licence from the Authority but the Authority shall assess the technical feasibility of the business and assess any risks to customers.
