Section 39, The Employment Act, 2023

A provision in an agreement, whether or not it is a contractof employment, shall be void in so far as it purports to- (a) exclude or limit the operation of a provision of this Act to the detriment of a worker; or (b) precludes a person from- (i) presenting a complaint under this Act to the Commissioner or the High Court; (ii) initiating or enforcing proceedings under this Act in the High Court; or (iii) giving evidence in connection with a complaint or proceeding, unless contained in a written agreement in relation to an alternative dispute settlement mechanism.
