Section 65: An industrial action which -

(a) is in breach of this Act or a collectively agreed
procedure for the settlement of industrial
disputes applicable to the trade dispute in
question; and
(b) provides, expressly or impliedly, that the
collectively agreed procedure shall be
exhausted before industrial action is taken,
shall be deemed to be an unlawful industrial action and may be
prohibited by order of the Industrial Court.
