Section 14, The National Fertilizer Regulations, 2020.

(1) The Agency may refuse an application for a licenceto manufacture or import fertilizer made in accordance with Regulation 11 or to carry on the business of distributing or retailing fertilizer in accordance with Regulation 12 where it is satisfied that the- (a) applicant has been convicted of an offence under the Act or these Regulations within 3 years preceding the date of making the application; 14 15 Application for licence to distribute or retail fertilizer. Grant of licence. Refusal of licence. (b) a business partner of the applicant has been convicted of an offence under the Act or these Regulations; (c) applicant has been convicted of an offence under the Act or these Regulations and intends to register a new business with another name; (d) the application is not accompanied with the prescribed application fee; (e) the application is incomplete; or (f) the applicant fails to provide the information required under sub-regulations (2) of Regulations 11 and sub regulation 2 of Regulation 12. (2) Where the Agency refuses an application under subregulation (1) it shall notify the applicant of the reasons for the refusal.
