Section 61, The Public Procurement Act, 2016

When the services are of an exceptionally complex natureof a considerable impact on future projects or national economy or when they may lead to the submission of proposals which are difficult to compare, the consultant may, subject to the approval of the procurement committee, be selected exclusively on the basis of the technical quality of his proposal.
