Section 44, 62 of the Environmental Protection Act, 2008, the Board hereby makes

(1) Adjustment to new standards for on-going miningoperations shall be prescribed by the Board and shall be gradually and progressively undertaken by the holder of the mineral right within a reasonable period of time prescribed by the Board. (2) The period of time referred to in sub-regulation (1) shall be determined by the Board on a case by case basis and always in consultation with the appropriate industry specialists. (3) Exceptionally, and for only one time, the Board may extend the period referred to in sub-regulation (2) for such extended term it deems necessary, if the social cost of standards implementation is greater than the overall benefit to the local community.
