Section 67, 62 of the Environmental Protection Act, 2008, the Board hereby makes

(1) An application for environmental licence undercategories EIA or ESIA shall be submitted to the Board in accordance with section 24 of the Act. (2) The Minerals Advisory Board shall not consider an application for exploration, small scale or large scale mining right or permit unless the applicant submits an enviromental licence granted to it by the Board. (3) An application for an environmental licence under sub-regulation (1) shall– (a) provide details of any significant adverse effects that– (i) a reconnaissance operations is likely to have on the environment and on any monument or relic in the proposed reconnaissance area and an estimate of the cost of combating such adverse effects in accordance with paragraph (J) of section 57 of the Mines and Minerals (ii) an exploration operation is likely to have on the environment and on any monument or relic in the proposed exploration licence area and an estimate of the cost of combating such adverse effects in accordance with paragraph (J) of section 70 of the Mines and Minerals (b) an environmental impact assessment licence as prescribed under the Environment Protection Act as a condition for granting a small-scale mining licence or a large-scale mining licence in accordance with subsection (2) of section 131 of the Mines and Minerals 62 63 Duties of mineral right holder. (c) be accompanied by a statement on the consequences of dredging including the destruction of monuments and relics, sacred places and burial grounds in accordance with paragraph (a) of subsection (2) of section 228 of the Mines and Minerals Act, 2009.
